Website: 305fleet.com

By completing a reservation, you agree to the 305Fleet Terms of Service, Rules of the Road, and applicable Vehicle Rental Agreement.

1. Terms That Apply to Your Rental

These Terms govern the website, booking process, reservations, payments, communications, and general services provided by 305Fleet.

Each vehicle rental is also governed by the applicable:

  • 305Fleet Vehicle Rental Agreement;
  • confirmed Wheelbase reservation and Reservation Receipt;
  • 305Fleet Rules of the Road;
  • checkout and check-in records;
  • vehicle-specific instructions or disclosures;
  • applicable insurance or protection-plan terms; and
  • written amendments or special terms agreed to by 305Fleet and the renter.

These documents collectively form the agreement applicable to the rental.

If a reservation-specific term shown on a confirmed reservation conflicts with these Terms, the reservation-specific term controls as to that particular item.

If these Terms conflict with the Vehicle Rental Agreement regarding possession, operation, authorized drivers, vehicle condition, damage, insurance, prohibited use, geographic restrictions, vehicle recovery, or return of the vehicle, the Vehicle Rental Agreement controls.

2. Eligibility to Rent

To rent a vehicle from 305Fleet, you must:

  • be legally capable of entering into a binding contract;
  • meet the minimum age requirement applicable to the reservation;
  • possess a valid, unexpired driver’s license acceptable for the rental;
  • complete any required identity and driver verification;
  • meet applicable insurance or protection requirements;
  • provide accurate and complete information; and
  • provide a valid payment method accepted by the booking platform.

All authorized drivers must independently satisfy applicable driver eligibility requirements.

305Fleet may decline or cancel a reservation where eligibility, identity verification, driver’s-license verification, payment, fraud-prevention, insurance, protection, security, or other reasonable rental requirements are not satisfied.

3. Driver’s License Verification

Florida law requires a vehicle renter to be duly licensed.

305Fleet or its authorized service provider may inspect, electronically verify, or otherwise validate a renter’s driver’s license and confirm that it is unexpired before allowing possession of a vehicle.

By booking with 305Fleet, you authorize reasonable driver’s-license and identity verification for purposes of determining rental eligibility and preventing fraud.

4. Reservations

305Fleet currently uses Wheelbase and may use other authorized third-party platforms or service providers to process reservations.

A reservation is not final until it has been confirmed through the applicable booking system and all required payment, verification, documentation, deposit, and electronic-signature requirements have been completed.

Reservation-specific information may include:

  • vehicle;
  • pickup and return dates and times;
  • rental price;
  • mileage allowance;
  • taxes and fees;
  • security deposit;
  • delivery or pickup charges;
  • add-ons;
  • insurance or protection selection; and
  • other reservation-specific terms.

The confirmed reservation and Reservation Receipt are incorporated into the rental transaction.

5. Accuracy of Information

You agree to provide truthful, complete, current, and accurate information throughout the booking and rental process.

This includes information concerning your:

  • identity;
  • driver’s license;
  • address;
  • date of birth;
  • telephone number;
  • email address;
  • payment method;
  • insurance;
  • additional drivers; and
  • other information reasonably required for the rental.

Providing materially false, misleading, fraudulent, incomplete, or unauthorized information may result in rejection or cancellation of the reservation, refusal to release the vehicle, termination of the rental, recovery of the vehicle, denial of future rentals, or other remedies permitted by law or the Vehicle Rental Agreement.

6. Pricing

Rental pricing is based on the price displayed or confirmed for the applicable reservation.

Rates may vary based on:

  • vehicle;
  • rental dates;
  • rental duration;
  • demand;
  • season;
  • pickup or delivery location;
  • mileage;
  • add-ons;
  • insurance or protection products;
  • taxes;
  • fees; and
  • other reservation-specific factors.

305Fleet may change pricing for future reservations at any time before a reservation is confirmed.

Once confirmed, the applicable reservation price will control, subject to approved modifications, extensions, additional usage, additional services, penalties, damage, mileage, fuel or charging shortages, tolls, violations, or other properly chargeable amounts.

7. Payment Authorization

By completing a reservation, you authorize 305Fleet and its authorized booking and payment providers to charge the payment method associated with your reservation for amounts properly due under the reservation, these Terms, or the Vehicle Rental Agreement.

Such charges may include, where applicable:

  • rental charges;
  • taxes and fees;
  • security deposits;
  • delivery charges;
  • add-ons;
  • rental extensions;
  • excess mileage;
  • fuel or charging shortages;
  • late-return charges;
  • cleaning charges;
  • smoking or vaping charges;
  • tolls;
  • parking charges;
  • citations and violations;
  • towing and impound charges;
  • lost keys or equipment;
  • insurance or protection deductibles;
  • vehicle damage;
  • vehicle recovery expenses;
  • administrative charges permitted under the rental documents; and
  • other documented amounts properly owed under the rental agreement.

Some amounts may be charged after the rental ends if the applicable expense, toll, citation, damage, claim, or other obligation becomes known later.

8. Security Deposits

305Fleet may require a security deposit.

The amount, if applicable, will be disclosed in connection with the reservation.

A security deposit may be held and applied to amounts properly owed by the renter, including:

  • vehicle damage;
  • deductibles;
  • excess mileage;
  • missing fuel or battery charge;
  • tolls;
  • violations;
  • extraordinary cleaning;
  • smoking or vaping;
  • missing equipment;
  • late-return charges; and
  • other amounts authorized under the Vehicle Rental Agreement.

Any remaining refundable amount will be released or refunded through the applicable payment processor.

The time required for a released authorization or refund to appear in a renter’s account may depend on the renter’s bank, card issuer, or payment provider.

9. Cancellation and Refunds

The cancellation and refund policy displayed through Wheelbase or the applicable booking system at the time a reservation is confirmed governs that reservation.

Cancellation terms may vary depending on the vehicle, booking date, rental date, reservation channel, or other booking conditions.

Certain charges may be non-refundable as disclosed during booking.

An early vehicle return does not create a right to a refund unless the applicable booking policy expressly provides otherwise or 305Fleet agrees otherwise in writing.

10. Reservation Changes

Reservation changes are subject to availability and 305Fleet approval.

Changes may affect:

  • price;
  • mileage allowance;
  • security deposit;
  • taxes;
  • fees;
  • insurance or protection charges;
  • delivery charges; and
  • other reservation terms.

A requested change is not effective until confirmed through Wheelbase or otherwise approved in writing by 305Fleet.

11. Rental Extensions

A renter may not retain a vehicle beyond the confirmed return date and time without prior approval from 305Fleet.

Extension requests must be approved before the existing rental period expires.

Submitting an extension request does not constitute approval.

Continued possession of a vehicle does not automatically extend the rental.

Approved extensions may result in additional rental charges, taxes, fees, protection charges, deposits, or other applicable costs.

12. Authorized Drivers

Only drivers who are listed, approved, and verified for the applicable reservation may operate a 305Fleet vehicle.

The renter may not allow any other person to drive the vehicle.

Allowing an unauthorized driver to operate the vehicle constitutes a material violation of the rental requirements and may affect insurance or protection coverage.

Additional requirements governing authorized drivers are contained in the Vehicle Rental Agreement.

13. Insurance and Protection

Each reservation must satisfy the insurance or protection requirements applicable to that rental before the vehicle is released.

Depending on the reservation, coverage may be satisfied through one of the following arrangements:

  • a protection or insurance product selected through Wheelbase or another approved provider; or
  • qualifying personal automobile insurance or other coverage accepted and verified for the reservation.

If the renter selects a Wheelbase or other third-party protection or insurance product, that coverage is governed exclusively by the applicable provider’s terms, conditions, exclusions, limits, deductibles, eligibility requirements, and claims procedures.

305Fleet does not modify, expand, guarantee, or independently interpret coverage provided by Wheelbase, Outdoorsy, an insurer, credit-card issuer, protection provider, or other third party.

If the renter declines an available protection or insurance product and instead relies on personal automobile insurance or other coverage, 305Fleet may require verification that such coverage applies to the rental vehicle and satisfies the requirements applicable to the reservation.

Verification may be performed by Wheelbase, 305Fleet, the renter’s insurer, a credit-card benefit administrator, or another authorized provider.

Acceptance of a renter’s personal insurance or other coverage does not guarantee payment of a claim.

The renter remains responsible for any deductible, exclusion, limitation, denial of coverage, uncovered loss, prohibited use, unauthorized driver, or other amount for which the renter is responsible under the Vehicle Rental Agreement.

Where the renter’s own liability insurance and personal injury protection coverage are intended to be primary for a particular rental, the applicable Vehicle Rental Agreement will contain any notice required by Florida law.

Selection of any insurance or protection option does not eliminate the renter’s obligation to comply with the Vehicle Rental Agreement, Rules of the Road, or applicable coverage requirements.

14. Rules of the Road

All renters and authorized drivers must comply with the 305Fleet Rules of the Road provided during the reservation process.

The Rules of the Road include requirements concerning matters such as:

  • smoking and vaping;
  • pets;
  • authorized drivers;
  • safe vehicle operation;
  • prohibited uses;
  • vehicle cleanliness;
  • fuel or battery charge;
  • tolls and parking;
  • airport procedures;
  • lockbox procedures;
  • accidents;
  • vehicle damage; and
  • mechanical issues.

Violation of the Rules of the Road may result in charges, termination of the rental, loss or denial of applicable protection, vehicle recovery, or other remedies where permitted by the Vehicle Rental Agreement and applicable law.

15. No Smoking or Vaping

Smoking or vaping of any kind is prohibited in all 305Fleet vehicles.

This includes cigarettes, cigars, marijuana, vaping products, and other smoke- or vapor-producing products.

Vehicles may be equipped with electronic smoking-detection technology.

A $250 smoking/vaping fee may be charged for each reasonably documented smoking or vaping incident unless a different amount is expressly disclosed for the reservation.

16. Pets

Pets are not permitted unless approved by 305Fleet in advance or otherwise required by applicable law.

The vehicle must be returned free from excessive pet hair, stains, odors, waste, damage, or other pet-related conditions requiring extraordinary cleaning or repair.

Nothing in these Terms is intended to restrict rights provided under applicable service-animal or disability law.

17. Vehicle Cleanliness

Normal vehicle use is expected and does not require the renter to professionally clean the vehicle.

However, a renter may be responsible for extraordinary cleaning reasonably required because of conditions beyond normal use, including excessive:

  • dirt;
  • sand;
  • stains;
  • spills;
  • smoke residue or odor;
  • pet hair;
  • food or beverage residue;
  • biological material; or
  • other unusual contamination.

18. Prohibited Use

A 305Fleet vehicle may not be used for:

  • illegal activity;
  • operation while impaired by alcohol, drugs, medication, or another impairing substance;
  • racing;
  • speed contests;
  • reckless driving;
  • burnouts;
  • drifting;
  • stunts;
  • unauthorized off-road use;
  • unauthorized towing;
  • rideshare, delivery, courier, or commercial transportation unless specifically authorized;
  • operation by an unauthorized driver;
  • sub-rental;
  • intentional abuse or misuse;
  • unauthorized repair or modification;
  • tampering with tracking, telematics, smoking-detection, or security equipment; or
  • other use prohibited by the Vehicle Rental Agreement.

Material prohibited use may result in termination of the rental, vehicle recovery, additional charges, loss or denial of applicable insurance or protection benefits, and financial responsibility for resulting losses.

19. Geographic Restrictions

Unless 305Fleet provides prior written authorization, vehicles may be operated only within the geographic area permitted by the Vehicle Rental Agreement.

A vehicle may not be taken outside an authorized area simply because navigation software, a booking platform, or another system permits the route.

Unauthorized travel may constitute a material breach of the rental agreement.

20. Vehicle Availability

305Fleet makes reasonable efforts to provide the vehicle reserved.

A specific vehicle may become unavailable due to:

  • an accident;
  • mechanical failure;
  • delayed return by a prior renter;
  • theft;
  • maintenance;
  • manufacturer recall;
  • safety concerns; or
  • circumstances outside 305Fleet’s reasonable control.

If the reserved vehicle becomes unavailable, 305Fleet may attempt to provide a comparable substitute.

If no reasonable substitute is available, 305Fleet may cancel the affected reservation and refund amounts collected for the unavailable rental as appropriate.

To the fullest extent permitted by law, 305Fleet is not responsible for consequential travel expenses arising solely from vehicle unavailability, including hotel costs, airfare, missed events, or alternative transportation expenses.

21. Vehicle Condition and Inspection

Vehicle condition may be documented before and after a rental using:

  • Wheelbase checkout and check-in records;
  • photographs;
  • video;
  • odometer readings;
  • fuel or battery readings;
  • inspection records;
  • telematics;
  • written notes; and
  • other reasonable documentation.

The renter should inspect the vehicle at pickup and promptly identify material pre-existing damage not shown in the checkout record.

The Vehicle Rental Agreement governs responsibility for damage occurring during the rental.

22. Fuel and Electric Vehicle Charging

The vehicle must be returned with the fuel level or battery state of charge required by the reservation or checkout record unless different written instructions are provided.

If returned below the required level, the renter may be responsible for the reasonable cost of restoring the fuel or charge together with an applicable disclosed service fee.

Renters of electric or plug-in hybrid vehicles are responsible for maintaining sufficient battery charge to operate and return the vehicle safely.

23. Mileage

The mileage allowance applicable to the rental is the allowance shown in the reservation, vehicle listing, or related booking materials.

Mileage exceeding the allowance may result in an excess-mileage charge at the rate applicable to the reservation.

Mileage may be verified using odometer readings, Wheelbase records, vehicle telematics, or other reasonable records.

24. Tolls, Parking, Tickets, and Violations

The renter is responsible for costs attributable to possession or use of the vehicle during the rental period, including:

  • tolls;
  • parking charges;
  • traffic citations;
  • parking citations;
  • red-light camera violations;
  • towing;
  • impound costs;
  • airport parking; and
  • other violations or charges.

Some charges may not be received until after the rental ends.

305Fleet may charge properly documented amounts and any applicable administrative processing charge permitted by the rental documents and applicable law.

25. Airport Pickup and Return

When a rental involves airport delivery or return, the renter must follow 305Fleet’s written pickup and return instructions.

Instructions may address:

  • airport or parking facility;
  • garage;
  • level;
  • row or zone;
  • parking space;
  • photographs;
  • parking tickets;
  • keys;
  • protective pouches;
  • lockboxes; and
  • return procedures.

Renters may be responsible for airport parking charges as disclosed in connection with the reservation.

A renter may also be responsible for charges resulting from incorrect or unauthorized parking, including additional parking, towing, citations, or reasonable vehicle-recovery costs.

26. GPS, Telematics, and Vehicle Technology

305Fleet vehicles may contain GPS, telematics, diagnostic, smoking-detection, remote-security, and other fleet-management technology.

305Fleet may use these systems for legitimate business purposes including:

  • theft prevention;
  • vehicle recovery;
  • locating overdue or unreturned vehicles;
  • fleet security;
  • mileage verification;
  • maintenance;
  • diagnostics;
  • investigation of unauthorized or prohibited use;
  • geographic compliance; and
  • protection of 305Fleet property.

Renters may not disable, remove, disconnect, obstruct, alter, or tamper with authorized tracking, telematics, security, or vehicle-management equipment.

Additional disclosures concerning these systems are contained in the Vehicle Rental Agreement.

27. Accidents, Damage, Theft, and Mechanical Problems

The renter must contact 305Fleet promptly in the event of:

  • an accident;
  • collision;
  • vehicle damage;
  • theft;
  • vandalism;
  • warning light;
  • flat tire;
  • breakdown; or
  • significant mechanical problem.

The renter must not continue operating a vehicle when continued operation may be unsafe or may reasonably cause additional damage.

The Vehicle Rental Agreement contains additional accident-reporting, police-report, documentation, insurance, repair, and cooperation requirements.

28. Vehicle Return

The vehicle must be returned at the date, time, location, and in the manner required by the reservation and written return instructions.

The renter remains responsible for the vehicle until it has been properly returned and secured in accordance with the applicable procedure.

A renter must promptly notify 305Fleet if circumstances prevent proper return.

29. Late or Unreturned Vehicles

Keeping a vehicle beyond the authorized rental period without approval is prohibited.

Late charges or additional rental amounts may apply as provided by the Vehicle Rental Agreement.

If a vehicle is materially overdue and the renter cannot be reached, 305Fleet may take reasonable lawful measures to locate and recover the vehicle.

Where appropriate under the circumstances and permitted by law, an unreturned vehicle may be reported to law enforcement.

30. Lost Keys and Equipment

The renter is responsible for keys and equipment provided with the vehicle.

This may include:

  • vehicle keys;
  • key fobs;
  • charging equipment;
  • lockboxes;
  • protective key pouches;
  • parking tickets;
  • adapters;
  • accessories; and
  • other equipment supplied with the rental.

The renter may be responsible for reasonable replacement, programming, delivery, towing, or recovery costs resulting from lost or damaged items.

31. Electronic Communications

By providing an email address or telephone number in connection with a reservation, you consent to receive communications reasonably related to:

  • inquiries;
  • reservations;
  • driver verification;
  • payments;
  • vehicle pickup;
  • vehicle return;
  • safety;
  • customer service;
  • claims;
  • disputes; and
  • other rental administration.

Communications may be delivered through email, SMS or text message, telephone, Wheelbase, or another booking or messaging platform.

Carrier message and data rates may apply.

Transactional communications necessary to administer an active rental may continue even if you opt out of promotional communications.

32. Electronic Records and Signatures

You consent to conducting reservation and rental transactions electronically.

Electronic signatures, initials, checkboxes, dates, acknowledgments, and electronic records may be used in connection with your reservation and rental documents.

To the extent permitted by law, an electronic signature or electronic acknowledgment has the same effect as a handwritten signature.

You are responsible for reviewing documents before electronically accepting or signing them.

You agree that documents and disclosures may be delivered electronically in a form that you can retain or print.

33. Website Use

You may use 305fleet.com for lawful personal purposes associated with reviewing or obtaining 305Fleet services.

You may not:

  • interfere with website operation;
  • attempt unauthorized access to systems or accounts;
  • submit fraudulent reservations;
  • impersonate another person;
  • misuse payment systems;
  • introduce malware or harmful code;
  • use automated systems to disrupt or improperly scrape the website;
  • circumvent security controls;
  • copy protected content for unauthorized commercial purposes; or
  • use the website for unlawful activity.

305Fleet may restrict website or booking access when reasonably necessary to protect its systems, customers, vehicles, employees, or business.

34. Website Information

305Fleet makes reasonable efforts to keep website and listing information accurate.

Vehicle descriptions, photographs, specifications, features, availability, rates, and other information may nevertheless change.

Photographs may be representative and minor differences may exist between online photographs and the specific vehicle supplied.

The confirmed reservation governs the specific transaction.

35. Third-Party Providers

305Fleet may use third-party services including:

  • Wheelbase;
  • Outdoorsy;
  • payment processors;
  • insurance or protection providers;
  • identity-verification providers;
  • mapping services;
  • analytics providers;
  • communications providers; and
  • other technology or business-service providers.

Use of third-party services may be subject to separate terms and privacy policies.

305Fleet is not responsible for the independent operation, security, availability, or privacy practices of third-party services that it does not control.

36. Privacy

305Fleet may collect, use, retain, and disclose personal information as reasonably necessary to:

  • provide rental services;
  • process reservations and payments;
  • verify drivers;
  • prevent fraud;
  • maintain fleet security;
  • administer claims;
  • respond to customer service inquiries;
  • comply with legal obligations; and
  • operate and improve its business.

305Fleet’s separate Privacy Policy, when posted, governs its privacy practices and is incorporated into these Terms by reference.

Third-party providers may separately process information according to their own privacy policies.

37. Fraud Prevention and Security

305Fleet may use reasonable measures to detect and prevent fraud, unauthorized payment, identity theft, vehicle theft, and other unlawful activity.

A reservation may be delayed, declined, cancelled, or subjected to additional verification if 305Fleet reasonably believes that a transaction may involve fraud, misrepresentation, unauthorized payment, identity theft, or a material security risk.

305Fleet may cooperate with payment providers, insurers, protection providers, law enforcement, and other appropriate parties in investigating suspected unlawful conduct.

38. Payment Disputes and Chargebacks

If you believe a charge is incorrect, you should contact 305Fleet promptly so the issue can be reviewed.

Filing a chargeback or payment dispute does not eliminate a renter’s obligation to pay amounts that are legitimately owed.

In responding to a payment dispute, 305Fleet may provide relevant documentation to payment processors, banks, or card issuers, including:

  • reservation records;
  • signed agreements;
  • electronic acknowledgments;
  • photographs;
  • inspection records;
  • communications;
  • payment authorizations;
  • telematics records; and
  • documentation supporting the disputed charge.

39. Post-Rental Charges

Certain amounts associated with a rental may not become known until after the vehicle is returned.

These may include:

  • tolls;
  • parking charges;
  • traffic violations;
  • subsequently identified damage;
  • insurance or protection deductibles;
  • towing;
  • claim-related amounts;
  • missing equipment; and
  • other delayed charges attributable to the rental.

Where authorized under the Vehicle Rental Agreement and applicable law, these charges may be processed after the rental ends.

305Fleet will maintain reasonable supporting documentation for material post-rental charges.

40. Events Outside 305Fleet’s Control

305Fleet is not responsible for failure or delay caused by circumstances outside its reasonable control, including:

  • hurricanes or severe weather;
  • flooding;
  • road or airport closures;
  • government restrictions;
  • civil emergencies;
  • power failures;
  • internet or telecommunications outages;
  • third-party platform failures;
  • vehicle recalls;
  • accidents;
  • theft;
  • unexpected mechanical failures; or
  • other comparable circumstances.

305Fleet will make reasonable efforts to address affected reservations when practicable.

41. Website Availability

305Fleet does not guarantee uninterrupted or error-free operation of its website, booking system, or third-party services.

Online services may occasionally be unavailable because of maintenance, technical problems, security issues, or third-party outages.

42. Intellectual Property

The 305Fleet name, logo, branding, original website content, graphics, photographs owned by 305Fleet, and other proprietary materials are owned by or licensed to Turomina LLC unless otherwise stated.

Website content may be used for personal, non-commercial purposes related to evaluating or using 305Fleet services.

Protected content may not be copied, sold, modified, distributed, licensed, or commercially exploited without authorization.

43. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TUROMINA LLC DBA 305FLEET WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF THE WEBSITE, BOOKING SERVICES, A WEBSITE INTERRUPTION, OR THE UNAVAILABILITY OF A RESERVED VEHICLE.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, HOTEL EXPENSES, AIRFARE, MISSED EVENTS, LOST BUSINESS OPPORTUNITIES, ALTERNATIVE TRANSPORTATION COSTS, OR SIMILAR CONSEQUENTIAL LOSSES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Liability arising from possession or operation of a rental vehicle is further governed by the Vehicle Rental Agreement, applicable insurance or protection documents, Florida law, and applicable federal law.

44. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Turomina LLC dba 305Fleet and its officers, employees, and agents from third-party claims, liabilities, losses, damages, and reasonable expenses arising from:

  • your unlawful use of the website;
  • materially fraudulent information supplied by you;
  • your material violation of these Terms;
  • your prohibited or unlawful use of a rental vehicle; or
  • your material breach of the Vehicle Rental Agreement.

This provision does not require indemnification for liability that applicable law does not permit to be transferred.

45. No Waiver of Non-Waivable Rights

Nothing in these Terms is intended to waive, restrict, or eliminate any consumer right, statutory protection, remedy, or liability that cannot lawfully be waived or limited under applicable law.

46. Suspension or Refusal of Future Service

305Fleet may decline future reservations or restrict access to its services where reasonably justified by:

  • fraud;
  • nonpayment;
  • prior material breach;
  • vehicle misuse;
  • unsafe conduct;
  • unauthorized vehicle use;
  • intentional damage;
  • abusive or threatening conduct;
  • repeated violation of rental rules; or
  • substantial security concerns.

Outstanding obligations from an existing rental remain enforceable where permitted by law.

47. Governing Law

These Terms and transactions with 305Fleet are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

48. Venue

To the extent permitted by applicable law, any court proceeding arising from these Terms or 305Fleet services shall be brought in an appropriate state or federal court located in Broward County, Florida.

Nothing in this provision requires a proceeding to be brought in Broward County if applicable law requires a different venue.

49. Changes to These Terms

305Fleet may update these Terms from time to time.

The version posted on 305fleet.com will display its effective date.

Changes generally apply prospectively.

The Terms in effect when a reservation is confirmed will govern that reservation unless:

  • the renter and 305Fleet expressly agree otherwise;
  • a change is required by law; or
  • the reservation is materially modified and updated terms are presented and accepted.

Continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms for future website use.

50. Severability

If a provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in effect.

51. No Waiver

Failure by 305Fleet to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or any other provision.

52. Assignment

A renter may not assign or transfer a reservation or rights under these Terms without prior written approval from 305Fleet.

305Fleet may assign its rights and obligations in connection with a lawful sale, transfer, restructuring, merger, or reorganization of its business.

53. Entire Agreement

For website and booking matters, these Terms and incorporated policies constitute the agreement between the user and 305Fleet.

For an actual vehicle rental, the complete agreement additionally includes, as applicable:

  • the 305Fleet Vehicle Rental Agreement;
  • the Wheelbase Reservation Receipt;
  • confirmed reservation information;
  • the Rules of the Road;
  • insurance or protection documents;
  • checkout and check-in records;
  • vehicle-specific instructions; and
  • written amendments agreed to by the parties.
